Welcome to Etoil. These terms govern your use of our M50 eToll and tag management services. Please read them carefully.

1. Agreement to Terms

By accessing or using Etoil's M50 eToll and tag management services ("Services"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access our Services.

Important: These terms include provisions for automatic toll payments, tag management, and your responsibilities as a user of M50 toll services in Ireland.

2. Our Services

Etoil provides automated M50 toll payment and electronic tag management services for individual drivers and fleet operators in Ireland.

2.1 Service Description

Our Services include:

  • Electronic tag provision and activation for M50 toll usage
  • Automated toll payment processing
  • Account management and reporting
  • Fleet management capabilities for multiple vehicles
  • Integration with accounting and fleet management systems

2.2 Service Availability

While we strive to maintain 99.9% service availability, we cannot guarantee uninterrupted access to our Services due to:

  • Scheduled maintenance and updates
  • Technical issues beyond our control
  • M50 toll system outages or maintenance
  • Force majeure events

3. Account Registration

To use our Services, you must register for an Etoil account and provide accurate, complete information.

3.1 Eligibility

You must be:

  • At least 18 years old
  • Capable of forming a binding contract
  • Using the Services for legitimate M50 toll payment purposes
  • In compliance with all applicable Irish laws and regulations

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Promptly notifying us of any unauthorized access
  • Ensuring your vehicle and tag information remains accurate

Security Notice: You are liable for all toll charges incurred through your account, regardless of whether you authorized the specific usage. Protect your account credentials carefully.

4. Payments and Billing

Our fee structure and billing practices are designed to be transparent and fair.

4.1 Toll Charges

You authorize us to:

  • Charge your payment method for M50 toll fees as they occur
  • Apply applicable administrative fees as outlined in our pricing
  • Process payments immediately upon toll usage detection

4.2 Pricing Structure

4.3 Payment Methods

We accept the following payment methods:

  • Credit/Debit Cards (Visa, MasterCard, American Express)
  • Bank transfers (SEPA)
  • Direct debit authorization
  • Prepaid account balances

4.4 Disputed Charges

If you believe a charge is incorrect, you must notify us within 30 days of the charge date. We will investigate and respond within 10 business days.

5. Tag Usage and Responsibilities

Proper use of Etoil tags is essential for accurate toll processing.

5.1 Tag Installation

You must:

  • Install the tag properly on your vehicle's windshield
  • Ensure the tag is not obstructed or damaged
  • Register each tag to the correct vehicle
  • Notify us immediately if a tag is lost, stolen, or damaged

5.2 Tag Transfer and Deactivation

Tags are registered to specific vehicles and cannot be transferred without updating your account. Deactivated tags must be returned to Etoil upon request.

5.3 Toll Usage Outside M50

While our primary service covers M50 tolls, we may expand to other Irish toll roads. Additional terms will apply to extended coverage areas.

6. Fleet Management Terms

Additional terms apply to fleet account holders.

6.1 Account Management

Fleet administrators are responsible for:

  • Managing sub-accounts and user permissions
  • Ensuring all vehicle information is accurate
  • Monitoring fleet toll usage and spending
  • Communicating these terms to all drivers

6.2 Reporting and Analytics

Fleet accounts include access to advanced reporting features. Usage data is available for internal business purposes only and may not be resold or redistributed.

7. Intellectual Property

All Etoil intellectual property, including software, trademarks, and business methods, remains our exclusive property. You may not:

  • Reverse engineer or decompile our software
  • Use our trademarks without permission
  • Copy or distribute our proprietary methods
  • Create derivative works based on our Services

8. Limitation of Liability

To the extent permitted by Irish law, Etoil's liability is limited as follows:

8.1 General Limitation

Our total liability for any claim related to our Services shall not exceed the total fees paid by you in the 6 months preceding the claim.

8.2 Exclusions

We are not liable for:

  • Traffic fines or penalties incurred while using M50
  • Delays or failures in toll processing beyond our control
  • Consequential damages or lost profits
  • Issues caused by improper tag installation or use

Important: While we process toll payments automatically, ultimate responsibility for toll compliance rests with the vehicle owner/operator according to Irish transportation laws.

9. Termination

Either party may terminate these terms under the following conditions:

9.1 By You

You may close your account at any time by:

  • Providing 30 days written notice
  • Settling all outstanding balances
  • Returning all Etoil tags in your possession

9.2 By Etoil

We may suspend or terminate your account if:

  • You breach these terms
  • You fail to pay amounts when due
  • We suspect fraudulent activity
  • Required by law or regulatory authority

10. Governing Law and Dispute Resolution

These terms are governed by Irish law. Any disputes shall be resolved through the following process:

10.1 Informal Resolution

We strongly encourage you to contact us first to resolve any issues informally.

10.2 Formal Proceedings

If informal resolution fails, disputes shall be resolved in the courts of Ireland, with Dublin as the preferred venue.

10.3 Class Action Waiver

You waive any right to participate in class actions against Etoil, agreeing to pursue claims individually.

11. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes through:

  • Email notification to registered users
  • In-app notifications
  • Posting updated terms on our website

Continued use of our Services after changes constitutes acceptance of the modified terms.
